In some ways, a wrongful death case is just like any other case, in terms of the law. It could have been caused by a negligent driver, toxic pesticides, or medical malpractice. There are many, many ways to die at the hands of a negligent tortfeasor. But there is a specific statute that tells us who may sue and for what. Don't let the death of a loved one go unpunished. Relevant law is found in the Hawaii Revised Statutes, 663-3, entitled "Wrongful Death Act." It tells us that "When the death of a person is caused by the wrongful act, neglect, or default of any person, the deceased's legal representative (and/or the surviving spouse, reciprocal beneficiary, children, father, mother, and by any person wholly or partly dependent upon the deceased persons)... may maintain an action against the person causing the death or against the person responsible for the death." The law also indicates that the lawsuit can recover such things as the "loss of society, companionship, comfort, consortium, or protection," "loss of marital care, attention, advice, or counsel," and in the case of a deceased parent, "loss of parental care, training, guidance, or education, suffered as a result of the death of the person."
But legal matters aside, the death of a family member is catastrophic. The process of grieving and burial should take priority, and usually, when the dust clears, level heads start thinking of ways to help those damaged by death the most: the survivors.
