A. Slip and Falls: This is type of lawsuit sometimes called Premises Liability, or commonly called a Slip and Fall. Generally, if you fall and get hurt, you are not automatically entitled to sue and recover damages. THERE HAS TO HAVE BEEN SOME NEGLIGENCE BY THE DEFENDANT. Over the years, I have seen people slip on slick floors (maybe the wax caused it, or it was wet), I have seen people trip in potholes or places in the floors or stairs that were defective (perhaps the owner failed to inspect and maintain the property), and in Hawaii especially the footing is precarious, and lots of hotels and property owners simply don't design the area well, or they fail to keep it maintained, and someone gets hurt. If you fell because you weren't looking where you were going, or your clumsy, you cannot sue. However, I always listen to the facts from a new client, and I ask questions about the surface where they fell, the lighting, was there sand or water on the floor; should there have been a handrail in a pool for instance, or perhaps there is some other type of dangerous condition.
